This scheme provides coverage and protection for employees who suffers from employment injury. It means a personal injury to an employee caused by accident or an occupational disease arising out of an in the course of his employment in an industry to which this Act applies . Coverage The protection under this scheme covers the following accidents:- 1) Industrial accidents while carrying out their duties 2) Accidents while traveling. 3) Accident during emergency. On a route between his place of residence or stay and his place of work. On a journey between his place of work and the place where he takes his meal during any authorized recess An accident that occurs during any interruption or deviation shall not be deemed to arise out of and in the course of his employment. An accident happening to an employee while he is in or near any premises at which he is being employed and it occurs while assisting, rescuing or protecting other people from disaster or danger during an emergency. **Reporting Of Accident** Accident or Occupational Disease Reports should be lodged with the following documents: **Photocopy of Identification Card** Photocopy of Attendance Record / Punch Card for the month of accident that is verified by the employer or a confirmation letter by the employer in the absence of Attendance Record or Punch Card For commuting accidents or outside of the employer's premises **Original Police Report** Sketch of map (that shows starting point, travel route, place of accident and destination) NOTE: Employers shall submit the claim form and other relevant documents to SOC SO within 48 hours upon notification of the accident that have occurred to an employee. **BENEFITS UNDER THE SCHEME** Medical Benefit Temporary Disablement Benefit Permanent Disablement Benefit Constant-attendance Allowance Facilities for Physical and Vocational Rehabilitation Return To Work Program Dependents' Benefit Funeral Benefit Education Benefit

mployment Injury is the personal injury to an employee caused by an accident or by an occupational disease arising out of employment of the employee in a covered factory or establishment, and arising in the course of his employment in a covered factory or establishment. The site of the accident is immaterial and accident occurring or an occupational disease contracted even outside the territorial limits of India can result in entitlement to benefit under the ESI Act. Personal Injury The first essential condition of an employment injury is that personal injury must have been caused. The term 'personal injury' is somewhat wider than physical or bodily injury but does not include an injury to the belongings or reputation of the person. It covers any physiological injury, for example, a man suffering nervous shock or insanity as a result of witnessing a terrible accident might be regarded as suffering from personal injury. An emotional impulse, however, does not constitute an injury unless it is accompanied by some physiological injury. Further, compensation is payable for the result of the injury and not for the injury itself Thus, a man who suffers from shock would not get compensation unless the shock results in his being disabled.

Example : Fire disaster at employer's premise Reporting Of Accident ◾Accident or Occupational Disease Reports should be lodged with the following documents: i.Accident Report (Form 21) or Occupational Disease Report – PKS(P) 68 (if still working) or Occupational Disease Notice – PKS(P) 69 (if resigned) ii.Photocopy of Identification Card iii.Photocopy of Attendance Record / Punch Card for the month of accident that is verified by the employer or a confirmation letter by the employer in the absence of Attendance Record or Punch Card iv.For commuting accidents or outside of the employer's premises ◾ Original Police Report ◾ Sketch of map (that shows starting point, travel route, place of accident and destination) When To Report The Accident? Employers shall submit the claim form and other relevant documents to SOCSO within 48 hours upon notification of the accident that have occurred to an employee. Employment injury means a personal injury to an employee caused by accident or an occupational diseases arising out of and in the course of employment. There are some cases where accident arises outside the premises and even before and after working hours is to be considered for insurable amount.
