Hi, (i) closely resemble the goods being valued in terms Of characteristics and component materials (ii) can perform the same functions and are commercially interchangeable with the goods being valued’ (iii) are produced in the same country as the goods being valued; and (iv) are produced by the producer of the goods being valued. Where similar goods produced by the same produced are not available, similar goods produced by a different producer can be considered.

1. If the customs value of goods, imported to the customs territory of the Customs Union, cannot be determined in conformity with Articles 4 and 6 of the present Agreement, the customs value of such goods is seen as the price of a deal with homogeneous goods, sold for the export to the customs territory of the Customs Union and imported to the customs territory of the Customs Union in the same or in the corresponding to it period of time as the imported goods, but not earlier than 90 calendar days before the import of valued (imported) goods. To determine the customs value of the valued (imported) goods in conformity with the present Article, the price of a deal with homogeneous goods, sold on the same commercial level and essentially in the same quantity as the valued (imported) goods, shall be applied. If no such sales have been revealed, the price of a deal with homogeneous goods, sold on the same commercial level but in other quantities, shall be used. If such sales are not revealed either, the price of a deal with homogeneous goods, sold on a different commercial level but in the same quantities, shall be applied. And if such sales are not revealed, the price of a deal with homogeneous goods, sold on a different commercial level and in other quantities, shall be used. Information, provided in the present paragraph, is to be applied with making the corresponding correction of the price, which takes into account distinctions in the commercial level of the sale and (or) in the quantity of goods. Such correction shall be carried out on the basis of information, documentary confirming the substantiation and precision of the correction, regardless of whether it leads to a growth or to a reduction in the cost of the deal with homogeneous commodities. If such information is absent, the method for determining the cost of a deal with homogeneous commodities is not to be applied. 2. If necessary, when the customs value of valued (imported) goods is determined in accordance with the present Article, the price of a deal with homogeneous goods shall be corrected for taking into account a considerable difference in the conditions, pointed out in Sub-items 4-6 of Item 1 of Article 5 of the present Agreement, with respect to the valued and the homogeneous goods, due to differences in distances of transport, and in types of transport. 3. If more than one price of a deal with homogeneous goods is revealed (taking into account relevant corrections, made in accordance with Items 1-2 of the present Article), for determining the customs value of the valued goods, the lowest of these shall be applied.

Hie Uma, Similar goods have been deemed in the ACV as goods which: (i) closely resemble the goods being valued in terms Of characteristics and component materials (ii) can perform the same functions and are commercially interchangeable with the goods being valued’ (iii) are produced in the same country as the goods being valued; and (iv) are produced by the producer of the goods being valued. Where similar goods produced by the same produced are not available, similar goods produced by a different producer can be considered. The definition of similar goods excludes imported goods for which engineering, development, artwork, design work, plans or sketches are undertaken in the country of importation and are provided by the buyer to the producer of the goods free of charge or at reduced cost. An example of similar goods is interchangeable rubber tubes imported from two different producers with different trademarks but of the same standard, quality and equivalent reputation as well as similar characteristics, components and functions for use by motor vehicle manufacturers. Normal grade sodium peroxide for bleaching and special grade pure sodium peroxide for analytical purposes are not similar goods as ­they have different specifications and are not inter­changeable.

An importer has imported mobile phones, which looks like i phone from China (Manufacturer: Pine apple) (But Transaction value not applicable) Identical goods: An another importer has imported from manufacturer Pine apple and from china, the same model and which has same technical features (But colour may differ). If not from the manufacturer Pine apple, it can be imported from another manufacturer but from china only. Similar goods: An another importer has imported from manufacturer pine apple and from china, a mobile which may or may not look like i phone and which may or may not contain the same features (But the core features like cam, operationg system, memory, touch screen etc.,) are same. If not from the manufacturer pine apple, it can be imported from another manufacturer but from china only.
