How to find out whether the deductee is individual or company or firm etc., For example invoice is in the name of ABC enterprises? in above example how do i determine the status of the deductee?

Helllo PAN of deductee will provide you detail whether deductee is individual or firm or company. The fourth character informs about the type of holder of the card as given below. A — Association of Persons (AOP) B — Body of Individuals (BOI) C — Company F — Firm G — Government H — HUF (Hindu Undivided Family) L — Local Authority J — Artificial Judicial Person P — Individual T — AOP (Trust)

The fifth character of the PAN is the first character (a) of the surname or last name of the person, in the case of a "Personal" PAN card, where the fourth character is "P" or (b) of the name of the Entity, Trust, society, or organisation in the case of Company/ HUF/ Firm/ AOP/ BOI/ Local Authority/ Artificial Judicial Person/ Govt, where the fourth character is "C","H","F","A","T","B","L","J","G". Usually PAN of the party is mentioned on the invoice. As answered by others depending on 4 th letter you can know the deducteee status and accordingly TDS is to be deducted u/s 194 C @ 1% (individual or HUF) or 2% (for all others). Many times assesse gets notice for short deduction under section 194 C. I would advice you to maintain a excel sheet for the all party and their PAN numbers, as it makes it quite simple to sort all types of deductees. For Eg, After entering the PAN number in Column A enter the formula "=LEFT(RIGHT(A1,7))" in column B. It will give you the result whether the deductee is A,B,C,F,G,H,L,J,P OR T after which you can filter the data and calculate TDS accordingly.

Dear frd, your question is about the how to findout the status of party to whom our client has made Payment for expense covered under section 194C as contract. It is very much eazy to find out status of party to whom payment has made for expenses if you known the PAN no. of the party. If you checking the account of your party whether your client maintained accounting data in Tally, Mirecle, Shree whatever you may find party pan no. from ledger detail of the party (i..e from party Master). Or you can ask to your client about pan number of the such party. From pan number you can decide the status of party that whether the party is individual or firm. On the pan card if the 4th alfabet is "I" than the party to whom payment made is the indiviual and if the pan card 4 th alfabet is "P" then the party to whom payment is made is Partnership firm. If the party is indiviual or HUF than 1% TDS is required to deduct under section 194 C otherwise the rate of TDS is 2% under section 194C. I hop u setisfied this my answer thanking you.

Hi, Permanent Account Number (PAN) is a code that acts as identification of Indians, especially those who pay Income Tax. It is a unique, 10-character alpha-numeric identifier, issued to all judicial entities identifiable under the Indian Income Tax Act 1961. IT PAN card is issued under Section 139A of the Income Tax Act. The PAN structure is as follows: AAAPL1234C: First five characters are letters, next four numerals, last character letter. The first three letters are sequence of alphabets from AAA to ZZZ The fourth character informs about the type of holder of the card. At the time of making any payment TDS is required to be deducted by the person making the payment....**section 194C which deals with TDS on payment to Contractor and Sub Contractor.** any person responsible for paying any sum to a Resident Contractor for carrying out any work (including supply of labor for carrying out any work) under a contract shall deduct TDS u/s 194C. Rate of TDS will be: **1% if the payment is made to individuals or HUF** ****2% in all other case**** If the payment does not exceed 30000 no TDS will be deducted.
