According to the Factories Act annual leave of 12 working days for all the workers who have worked at least 240 days in a year is provided. But the period of annual leave is different for adult and child workers.

According to the Factories Act annual leave of 12 working days for all the workers who have worked at least 240 days in a year is provided. But the period of annual leave is different for adult and child workers. An adult worker is eligible to 1 day of earned leave for every 20 days of service he has provided A child worker who is below the age of 15 years is entitled to 1 day of earned leave for every 15 days of service provided.

hello friend #Factories act 1987# Annual leave with wages Section 79 describe the condition for annual leave with wages. need to work minimum 240 day in current year to get leave with wages benefit in next year. If any person had worked 300 days in current year than he can get leave with wages in NEXT year as follow 1. if he is adult than he is eligible for 1 leave with wages for every 20 days working of current year ------- means 1/20 x 300 = 15 days 2. if he is a child than he is eligible for 1 leave with wages for every 15 days working of current year ------- means 1/15 x 300 = 20 days this is a big section you can read full description of section 79 in factory act 1987

Hiiii friend... Annual Leave with Wages ----------------------- (1) Every worker shall be allowed leave with wages for a number of days calculated at the rate of - (a) if an adult, one day for every twenty days of work performed by him, and (b) if a young person, one day for every fifteen days of work performed by him : Explanation: For the purpose of calculating leave under this sub-section - (a) any day on which no work or less than half a day's work is performed shall not be counted, and (b) any day on which half or more than half a day's work is performed shall be counted as one day. Explanation II : The leave admissible under this sub-section shall be exclusive of all holidays, whether occurring during, or at either end of, the period of leave. (2) If a worker does not in any one period of twelve months take the whole of the leave allowed to him under sub-section (1) any leave not taken by him shall be added to the leave to be allowed to him under that sub-section in the succeeding period of twelve months. (3) A worker shall cease to earn any leave under this section when the earned leave due to him amounts to thirty days. (4) If the employment of a worker who is entitled to leave under this section is terminated by the employer before he has taken the entire leave to which he is entitled, the employer shall pay him the amount payable under Sec. 3 in respect of the leave not taken, and such payment shall be made before the expiry of the second working day after such termination.

ANNUAL LEAVE WITH WAGES Hi, According to the Factories Act annual leave of 12 working days for all the workers who have worked at least 240 days in a year is provided. An adult worker is eligible to 1 day of earned leave for every 20 days of service he has provided A child worker who is below the age of 15 years is entitled to 1 day of earned leave for every 15 days of service provided. Workers are paid their full daily wage during the period of annual leave. Daily wages means the average of worker's total full time earnings for the day on which he actually worked during the months immediately preceding his annual leave, but excluding any overtime and bonus and including dearness allowance and the cash equivalent of advantage accruing through the concessional sale to the worker of food grains and other articles. SEC 79 describes Annual leave with wages (1) Every worker who has worked for a period of 240 days or more in a factory during a calendar year shall be allowed during the subsequent calendar year, leave with wages for a number of days calculated at the rate of :- if an adult, one day for every twenty days of work performed by him during the previous calendar year ; if a child, one day for every fifteen days of work performed by him during the previous calendar year. Explanation1: For the purposes of this sub-section :- any days of lay-off; by agreement or contract or as permissible under the standing orders; in the case of a female worker, maternity leave for any number of days not exceeding twelve weeks; and the leave earned in the year prior to that in which the leave is enjoyed; shall be deemed to be days on which the worker has worked in a factory for the purpose of computation of the period of 240 days or more, but he shall not earn leave for these days. Explanation 2: The leave admissible under this sub-section shall be exclusive of all holidays whether occurring during or at either end of the period of leave.
